Information on the processing of personal data

INFORMATION ON THE PROCESSING OF PERSONAL DATA CARRIED OUT AS PART OF THE NAVIGATION AND USE OF THE CONTENTS OF THE WEBSITE PURSUANT TO AND FOR THE PURPOSES OF ARTICLE 13 OF EU REGULATION 679/16.

Pursuant to EU Reg. 679/16, this page describes the methods for processing the personal data of users who consult the Owner's website accessible at the following addresses https://www.jostechnology.com/    https://www.jostechnology.it.

This information does not concern other sites or pages or online services that can be reached via hypertext links that may be published on the site but which refer to resources outside the Owner's domain. 

As a result of consulting the site listed above, data relating to identified or identifiable natural persons may be processed.

1. WHAT PROCESSING DOES THE SITE CARRY OUT? 

A. Navigation data. 

The computer systems and software procedures used to operate this site acquire, during their normal operation, some personal data whose transmission is implicit in the use of Internet communication protocols. 

This category of data includes IP addresses, the browser used and its version, the device used and its operating system, and the country of origin of the visit. 

The legal basis is the legitimate interest of the Controller pursuant to Art 6.I lett. f ) of EU Reg. 679/16 and therefore the user's consent is not required. 

B. Processing of data communicated by the data subject.

The optional, explicit and voluntary sending of messages using the contact details of the Controller, involve the acquisition and processing of the sender's personal data such as e-mail address, first name, last name, professional qualification and contact data contained in the e-mail, and personal data contained in the body of the text.  

The legal basis for the processing is the fulfilment of contractual obligations pursuant to Art 6.I lett. b) of EU Reg. 679/16.  

C. Fulfilment of legal obligations.  

The Data Controller shall process the user's personal data also for the purpose of fulfilling the obligations imposed by the laws and regulations in force, such as, by way of example, making the data available to the Public Authorities in the event of access, checks and inspections. 

 The legal basis for the processing is the fulfilment of legal obligations pursuant to Art 6.I lett. c) of EU Reg. 679/16.  

D. Establishment and defence of the Controller's rights and legitimate interests.  

The Data Controller shall take every precaution to avoid disputes or litigation. The Data Controller may process the personal data of users in order to ascertain or defend their subjective legal positions in the course of legal proceedings or pre-litigation.  

The legal basis for the processing is the legitimate interest of the Controller pursuant to Article 6.I lett. f) of EU Reg. 679/16. 

 

2. FOR WHAT PURPOSES WILL YOU PROCESS MY DATA? 

A. Navigation data.

Navigation data, necessary for the use of web services, are processed for the purpose of: 

  • obtain statistical information on the use of the services (most visited pages, number of visitors per time slot or per day, geographical areas of origin, etc.); 
  • monitor the proper functioning of the services offered. 

B. Data communicated by the data subject. 

The data will be processed by the Data Controller in order to respond to the request of the data subject. The data controller will process the following data: e-mail address, name of the data subject and any personal data contained in the body of the message. 

C. Fulfilment of legal obligations.   

The Data Controller may process the identification and contact data of the data subject for the purpose of fulfilling legal obligations incumbent on the Data Controller. 

D. Establishment and defence of the rights and legitimate interests of the Data Controller. 

The Data Controller shall process the data of the data subject for the purpose of ascertaining and protecting his subjective legal positions. 
 

3. HOW WILL YOU PROCESS MY DATA? TO WHOM WILL YOU COMMUNICATE MY DATA?

A. Navigation data. 

The navigation logs are saved on servers, located within the territory of the European Union, owned by Servers of Aruba S.p.A. with registered office in Ponte San Pietro (BG), Via San Clemente n. 53. DPO contacts: dpo@staff.aruba.it  

Navigation data are only accessible to the pro tempore legal representative. 

Navigation data are not transferred by the Data Controller outside the territory of the European Union, nor are they subject to automated decision-making processes, including profiling. 

The navigation data are also accessible to LOGIS S.R.L. for purposes of assistance, support, maintenance formally appointed as personal data controller.    

B. Data communicated by the data subject.

The logs and data communicated by the user through the e-mail messages are saved on servers, located within the territory of the European Union, owned by Servers of Aruba S.p.A. with registered office in Ponte San Pietro (BG), Via San Clemente n. 53. DPO contacts: dpo@staff.aruba.it  

The personal data involved in the processing in question will not be transferred outside the territory of the European Union, will not be subject to automated evaluation and will not be subject to profiling either. 

C. Fulfilment of legal obligations.  

The data may be made available to the Public Authorities in the event of verifications and inspections. 

D. Establishment and defence of the rights and legitimate interests of the Data Controller. 

The Data Controller may disclose your data to legal advisers, lawyers and experts if such disclosure is necessary to establish or defend a right in court or in extrajudicial proceedings.

 

4. HOW LONG WILL YOU KEEP MY DATA? 

A. Navigation data.

Navigation data are stored for 365 days from the date of creation of the log, directly on the servers. This is without prejudice to possible extensions of the storage time as a result of requests from the Judicial Authorities.  

B. Data communicated voluntarily by the data subject.

The logs and data communicated by the user via are saved for 24 months from the date of receipt. 

C. Fulfilment of legal obligations.  

The data will be kept for the time required by the legal provisions in force. 

D. Establishment and defence of the rights and legitimate interests of the Data Controller.  

Data from any litigation will be kept for 10 years after the conclusion of the extrajudicial or judicial proceedings. 
 

5. COOKIE POLICY.

5.1. WHAT ARE COOKIES? 

Cookies are small text files that sites visited by users send to their terminals where they are stored and then transmitted back to the same sites the next time they visit. A cookie does not transmit any other data stored on the user's hard disk, nor does it transmit viruses or e-mail addresses.

A. TECHNICAL COOKIES

Technical cookies are those used for the sole purpose of "to carry out the transmission of a communication over an electronic communications network, or to the extent strictly necessary for the provider of an information society service explicitly requested by the subscriber or user to provide such a service"..

These are cookies that serve to carry out navigation or to provide a service requested by the user. They are not used for any other purpose and are normally installed by the website owner.

They can be further divided into the following categories.

Browsing or session cookies: they ensure normal navigation and use of the website (they are necessary for the proper functioning of the site, for example they allow remembering the logged-in user in case of subsequent access to the restricted area)

Functionality cookies: they allow the user to navigate according to a set of selected criteria (e.g. the cookie reminds the user the second time he logs in that a certain language has been preset).

The installation of technical cookies does not require the user's consent.

6. WHAT ARE MY RIGHTS?

You may, at any time, exercise the rights recognised by EU Reg. 679/16 by contacting the Data Controller at the addresses indicated in the heading of this notice.

  • Right to withdraw consent.  

You have the right to withdraw your consent at any time by contacting the Data Controller at the contact details indicated in the header of this notice. Withdrawal of consent does not in any way affect any ongoing business relationship. Withdrawal of consent does not affect the lawfulness of processing based on the consent previously given.

  • Right of access to personal data.  

You have the right to obtain confirmation from the Data Controller as to whether or not personal data concerning you are being processed and, if so, to obtain a copy of the personal data being processed, unless the granting of the copy would be detrimental to the rights and freedoms of other data subjects.

  • Right to rectification.  

You have the right to obtain from the Data Controller the rectification and updating of personal data and inaccurate information concerning you without undue delay. Taking into account the purposes of the processing, you also have the right to obtain the integration of incomplete personal data.

  • Right to cancellation.

You have the right to obtain from the Controller the deletion of personal data concerning you without undue delay if: the data are no longer necessary in relation to the purposes for which they were collected or processed; you revoke the consent on which the processing is based and there is no other legal basis for the processing; you object to the processing and there is no overriding legitimate reason for the processing; the personal data have been processed unlawfully; the personal data must be deleted in order to fulfil an obligation imposed by national or Community provisions.

  • Right of restriction of processing.  

You have the right to obtain from the Controller the restriction of the processing if: you contest the accuracy of the personal data, for the period necessary for the Controller to verify the accuracy of such personal data; the processing is unlawful and you request the restriction of use instead of erasure; you need the personal data for the establishment, exercise or defence of legal claims although the Controller no longer needs them; you object to the processing pending verification of whether the legitimate reasons of the Controller prevail. If the processing is restricted, personal data are processed, except for storage, only with your consent or for the establishment, exercise or defence of legal claims or to protect the rights of another natural or legal person or for reasons of public interest.

  • Right to object to processing.  

You have the right to object at any time to the processing of personal data concerning you, including profiling. The Controller will refrain from further processing your data unless it can demonstrate the existence of compelling legitimate grounds for processing which override your interests, rights and freedoms or for the establishment, exercise or defence of legal claims.

  • Right to lodge a complaint with the Supervisory Authority. 

You have the right to lodge a complaint with the Supervisory Authority by hand delivery at the offices of the Garante (at the address indicated below) or by registered letter with acknowledgement of receipt addressed to Data Protection Authority, Piazza di Montecitorio, 121, 00186 Rome or by sending a certified e-mail message to protocollo@pec.gpdp.it.
